1. Acceptance of Terms

By accessing or using PropClarity, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

PropClarity is a real estate investment analytics platform providing property analysis comparing long-term rental (LTR) and short-term rental (STR) performance. The Service aggregates data from third-party sources to generate financial projections and investment insights. All projections are estimates only and do not constitute financial advice.

3. Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate and complete registration information.
  • Notifying us immediately of any unauthorized use of your account.

We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Plans

PropClarity offers a Free tier and paid plans (Starter and Pro), billed monthly or annually, granting a set number of analysis credits per billing cycle.

4.2 Credits

Full property analyses cost 1 credit; ZIP code searches cost 0.5 credits. Unused credits may roll over for one billing cycle on paid plans. Free tier credits do not roll over.

4.3 Free Trial

Paid plans include a 14-day free trial. No credit card is required for the Free tier. You may cancel at any time before the trial ends without charge.

4.4 Refunds and Cancellation

Subscription fees are non-refundable except as required by law. You may cancel at any time; access continues until the end of the current billing period. We reserve the right to modify pricing with 30 days notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Resell or redistribute access to the Service without authorization.
  • Reverse-engineer or systematically extract data from the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt unauthorized access to any part of the Service or its systems.
  • Make investment decisions based solely on Service outputs without professional advice.

6. Intellectual Property

The Service and its original content are owned by PropClarity and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal investment research. Nothing in these Terms transfers any intellectual property ownership to you.

7. Third-Party Data

PropClarity sources property and market data from third-party providers including Zillow, RentCast, and AirDNA. This data is provided as-is and may be incomplete, inaccurate, or unavailable at times due to third-party outages.

We do not guarantee the accuracy or timeliness of any third-party data. All financial projections are estimates only and do not constitute financial, investment, legal, or tax advice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROPCLARITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS.

10. Indemnification

You agree to indemnify, defend, and hold harmless PropClarity and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Delaware.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the last updated date at the top of this page and may notify you by email. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
